COBRA

common mistakes regarding cobra

 

If you have not updated and resent your initial notice 3-4 times last year, you are not in compliance due to law changes.

 

If you have not updated your qualifying event notice 5-8 times last year, you are not in compliance due to law changes.

 

If you are discussing COBRA in an EXIT INTERVIEW you are in violation.

 

Registered mail is NOT a good way to send qualifying event notice.

 

A waiver for COBRA can be revoked.  Waivers are not recommended.

 

THERE IS NO STATUTE OF LIMITATIONS OF COBRA ENFORCEMENT – you can be fined for a violation back from 1986 to present or the date you had to start complying with Federal COBRA (1st of January of the year following 20 employees for more than ½ the total business day in the prior year)

 

FINES ARE COSTLY

 

IRS Excise Tax - $100/day per violation.  $200/day if a dependent is involved.

 

ERISA FINES - $110/day per violation per person.

 

The DOL has NEVER lost a law suit.

 

Ex-employee or dependents’ claims of those who did not receive a notice or was not PROPERLY notified of their rights.
